1. Acceptance of Terms
By accessing or using the Epic Marks website (epicmarks.com), placing an order, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these terms, please do not use our website or services.
These terms apply to all visitors, users, and customers of the Epic Marks website and services, including but not limited to:
- Browsing the website
- Creating an account
- Placing orders for custom printing services
- Using the gang sheet builder
- Purchasing supplies or products
- Using the Heat Press Room
- Participating in the Epic Rewards loyalty program
- Using Make Your Mark web-design, hosting, and customer-portal services
We reserve the right to refuse service to anyone for any reason at any time.
2. Products and Services
Epic Marks provides custom printing services including, but not limited to:
- DTF (Direct-to-Film) Transfers — Custom transfers printed on specialty film for heat application to fabric
- UV-DTF Transfers — Peel-and-stick decals for hard surfaces
- Sublimation Printing — Dye-sublimation prints for polyester and poly-coated substrates
- Custom Apparel — Garments with applied custom transfers
- Printing Supplies — Heat transfer materials, blanks, and accessories
- Heat Press Room — Self-service heat press equipment rental
We also provide Make Your Mark web-design services (website audits, website design and development, hosting, and a customer portal), which are governed by Section 10.
Product Descriptions: We strive to display our products and services as accurately as possible. However, we cannot guarantee that your computer monitor’s display of colors will be accurate. Colors may vary slightly from what appears on screen to the final printed product due to differences in digital displays and printing processes.
Availability: All products and services are subject to availability. We reserve the right to discontinue any product or service at any time without notice.
3. Custom Products Policy
Important: Custom printing is made-to-order. By placing an order for custom DTF transfers, UV-DTF stickers, sublimation prints, or any custom-printed product, you acknowledge and agree to the following:
3.1 Made-to-Order Nature
All custom transfers and prints are produced specifically for your order using the artwork you provide. Once production begins, your order cannot be canceled, modified, or returned except as outlined in our Returns and Refunds section.
3.2 File Review
Our team reviews all submitted files for print quality before production. If we identify issues with your files (low resolution, incorrect format, missing transparency, etc.), we will contact you before proceeding. We are not responsible for print quality issues caused by low-resolution or improperly prepared artwork that was approved for printing.
3.3 Production Timeline
- Orders placed before 2:00 PM Central Time on business days are processed same-day
- Orders placed after the cutoff are processed the next business day
- Rush processing is available for qualifying orders at checkout
- Production timelines are estimates and not guaranteed delivery dates
3.4 Artwork Approval
By submitting artwork and completing checkout, you confirm that:
- The files you upload are print-ready and meet our specifications
- You have reviewed your order for accuracy
- You authorize us to print your submitted designs

4. Ordering and Payment
4.1 Placing Orders
Orders may be placed through our website, in-store at our Round Rock, TX location, or via approved wholesale channels. Online orders require a valid email address and payment information.
4.2 Pricing
All prices are listed in US Dollars (USD) and are subject to change without notice. Prices displayed at the time of your order are the prices you will be charged. We are not responsible for typographical errors in pricing. If an error is discovered, we will contact you before processing the order.
4.3 Payment Methods
We accept the following payment methods:
- Credit and debit cards (Visa, Mastercard, American Express, Discover)
- Apple Pay
- Google Pay
All payments are processed securely through our payment processor, Square.
4.4 Order Confirmation
After placing an order, you will receive an email confirmation. This confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for reasons including:
- Product or service unavailability
- Errors in product or pricing information
- Suspected fraudulent activity
- Violation of these Terms of Service
4.5 Order Cancellation by Customer
You may request to cancel your order if it has not yet entered production. Contact us immediately at 512-649-3886 or [email protected]. Once production begins, orders cannot be canceled.
5. Shipping Policy
5.1 Shipping Rates
- Gang Sheet Shipping: $12.50 flat rate for gang sheet orders
- Free Shipping: On gang sheet orders totaling $50 or more (before tax)
- Supplies & Other Products: Calculated at checkout based on package weight and destination
- In-Store Pickup: Free, available at our Round Rock, TX location
5.2 Shipping Carriers
Orders are shipped via USPS or UPS at our discretion based on package size and destination. Delivery estimates are 2-5 business days for standard shipping within the continental United States.
5.3 Shipping Destinations
We currently ship within the United States only. International customers may use a US-based freight forwarder at their own risk and expense.

Orders placed before 2:00 PM are typically ready for same-day pickup. You will receive an email notification when your order is ready.
5.5 Risk of Loss
Risk of loss and title for products passes to you upon delivery to the carrier. We are not responsible for delays, damage, or loss caused by the shipping carrier once the package has been shipped. If your package arrives damaged, please contact us within 24 hours with photos.
5.6 Address Accuracy
You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by the customer. Re-shipping due to customer-provided incorrect addresses will incur additional shipping charges.
6. Returns and Refunds
6.1 Custom Products
Because all custom printing is made specifically to your order using your submitted artwork, custom DTF transfers, UV-DTF stickers, sublimation prints, and custom-printed apparel are final sale and cannot be returned or refunded except in cases of:
- Print defects caused by our production process
- Damage during shipping (reported within 24 hours with photos)
- Order errors made by Epic Marks
6.2 Quality Issues
If you receive a product with a quality defect caused by our production process (color accuracy issues, print defects, adhesion problems, etc.), contact us within 24 hours of delivery with:
- Your order number
- Photos clearly showing the defect
- Description of the issue
Upon verification, we will offer a reprint or refund at our discretion.
6.3 Non-Returnable Items
The following items cannot be returned:
- Custom transfers and prints (made to your specifications)
- Gang sheet orders
- Opened or used supplies
- Heat Press Room sessions
- Design services
6.4 Supplies and Non-Custom Products
Unopened, unused supplies may be returned within 7 business days of purchase for store credit or exchange. Contact us before returning any items. Return shipping is the customer’s responsibility.
6.5 Refund Processing
Approved refunds will be processed to the original payment method within 5-10 business days.
6.6 Chargebacks
We encourage customers to contact us directly to resolve any issues before initiating a chargeback. Fraudulent chargebacks may result in account suspension and collection actions.
7. Intellectual Property
7.1 Epic Marks Content
All content on the Epic Marks website, including but not limited to text, graphics, logos, images, software, and design elements, is the property of Epic Marks or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Epic Marks content without our prior written permission.
7.2 Trademarks
“Epic Marks” and our logos are trademarks of Epic Marks LLC. You may not use our trademarks without our prior written permission.
7.3 Pre-Made Designs
Any pre-made designs, templates, or artwork sold by Epic Marks are licensed for personal or limited commercial use as specified at the time of purchase. Resale of Epic Marks designs or templates is prohibited.
8. User Content and Artwork
8.1 Your Responsibility
By submitting artwork, images, or designs for printing, you represent and warrant that:
- You own the artwork or have obtained all necessary rights, licenses, and permissions to use and reproduce it
- Your artwork does not infringe on any copyright, trademark, or other intellectual property rights of any third party
- Your artwork does not contain illegal, defamatory, obscene, or otherwise objectionable content
- Your artwork does not violate any applicable laws or regulations
8.2 Prohibited Content
We reserve the right to refuse to print any content that, in our sole discretion:
- Infringes on third-party intellectual property (copyrighted characters, logos, trademarked material without authorization)
- Contains hate speech, discriminatory content, or promotes violence
- Contains illegal content or promotes illegal activities
- Contains pornographic or excessively explicit material
- Contains content that could harm minors
- Violates any applicable laws
8.3 Indemnification for User Content
You agree to indemnify and hold harmless Epic Marks from any claims, damages, losses, or expenses arising from your submitted artwork or content. See Section 12 (Indemnification) for full details.
8.4 No Review Obligation
While we may review submitted content, we are not obligated to screen or approve all artwork before printing. The absence of rejection does not constitute approval or endorsement of your content.
8.5 Data Handling
Uploaded artwork is used solely for producing your order. We do not sell, share, or use your artwork for any purpose other than fulfilling your order. See our Privacy Policy for details on data handling.
9. Quality Guarantee
9.1 Our Commitment
Epic Marks is committed to providing high-quality custom printing. We stand behind our work and will make reasonable efforts to resolve quality issues caused by our production process.
9.2 What We Guarantee
- Accurate reproduction of your submitted artwork (within the limitations of the printing process)
- Proper adhesion when applied according to our recommended heat press settings
- Consistent color output based on your submitted files
9.3 What We Cannot Guarantee
- Exact color matching to your screen display (monitor colors vary)
- Results from improper application (incorrect temperature, pressure, or technique)
- Results on incompatible substrates or fabrics
- Quality of low-resolution or improperly prepared artwork
9.4 Application Support
For best results, follow our recommended application settings:
- Temperature: 260°F (127°C)
- Time: 6 seconds
- Pressure: Heavy
- Peel: Instant Hot Peel (immediately while hot)

10. Make Your Mark Web Services
This section governs your use of Epic Marks’ Make Your Mark web services — the Website Checkup audit, the customer portal at mym.epicmarks.com, and the websites we design and host for you. It supplements the rest of these Terms. The general provisions below — including Limitation of Liability (Section 11), Indemnification (Section 12), and Governing Law (Section 15) — apply to Make Your Mark web services as well.
10.1 The Services Agreement Controls
For any paid build or recurring-plan engagement, our signed Master Services Agreement (MSA) governs the commercial terms (scope, deliverables, ownership, fees, and cancellation). Where these Terms and a signed MSA conflict, the MSA controls for that engagement.
10.2 Accounts and Access
Portal sign-in is passwordless (a “magic link” sent to your email). You are responsible for the security of the email inbox used to sign in and for all activity under your account. Notify us promptly of any unauthorized use. Accounts are for the client business and its authorized users only.
10.3 The Services
- Website Checkup is a one-time paid audit of your existing website and online presence, delivered as a report. The audit fee is credited in full toward a website build if the build is commissioned within sixty (60) days, as described at purchase and in the MSA.
- Website builds are custom sites delivered from our shared design system and priced per package.
- Recurring plans (Care & Hosting, or Hosting & Portal) provide ongoing hosting, security, monitoring, the portal, and support as described for each plan.
10.4 Billing, Renewals, and Cancellation
- No free trial. Paid services begin when you purchase them; a staging/review site is provided only after a paid build.
- Card on file and auto-renewal. Recurring plans require a payment card on file. You authorize us to automatically charge that card each billing cycle (monthly or annually) via our processor, Square, until you cancel. Recurring charges appear on your statement as
SQ *EPIC MARKS. - Failed payments. If a charge fails, we may retry it and, if it remains unpaid, suspend your site and portal access until it is resolved.
- Cancellation. You may cancel a month-to-month plan with thirty (30) days’ notice; fees for the current period are not refunded and service continues through it. Annual prepaid plans are non-refundable and run to the end of their term.
- Full billing terms are set out in the MSA.
10.5 Your Content and Lead Data
- You retain ownership of the content you provide and grant us the license needed to build and host your site.
- You represent that your content and your business are lawful and do not infringe others’ rights, and that information on your site (hours, claims, licenses, pricing) is accurate.
- Lead forms. Your site may include a contact form; submissions are delivered to your designated inbox. As the controller of your visitors’ data, you are responsible for your own privacy notice and for complying with applicable law regarding the leads and customers you collect. We handle that data as your service provider, as described in our Privacy Policy.
10.6 Acceptable Use
You will not use the portal or a hosted site to publish or transmit unlawful, infringing, deceptive, malicious, or abusive content, to attempt to breach security or access others’ data, or otherwise in violation of these Terms or applicable law. We may remove offending content or suspend service.
10.7 Availability and Maintenance
Hosted sites run on third-party infrastructure (Cloudflare). We use commercially reasonable efforts to keep them available but do not guarantee uninterrupted or error-free service and provide no formal uptime SLA. We may perform maintenance and deploy updates (including to our shared design system) to keep sites secure and functional.
10.8 Intellectual Property (Web Builds)
On full payment, you own your delivered site and content and may take it with you (we can provide the source repository). Our underlying design system, reusable components, and tooling remain our property, and you receive a license to use them only as incorporated in your delivered site. Details are in the MSA.
10.9 No Results Guarantee
We do not guarantee any business result, including search-engine rankings, traffic, leads, or sales. Except as expressly stated in a signed agreement, web services are provided “as is” and “as available.”
11. Limitation of Liability
11.1 Disclaimer of Warranties
EPIC MARKS PROVIDES ITS WEBSITE AND SERVICES “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The website will be uninterrupted, secure, or error-free
- Results from using our services will meet your requirements
- Any errors will be corrected
11.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EPIC MARKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Loss of data
- Personal injury or property damage
- Any damages arising from your use or inability to use our services
11.3 Maximum Liability
IN NO EVENT SHALL EPIC MARKS’ TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER OR SERVICE GIVING RISE TO THE CLAIM. (For Make Your Mark web-service engagements governed by a signed Master Services Agreement, the limitation of liability stated in that agreement applies.)
11.4 Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Epic Marks, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of our website or services
- Your violation of these Terms of Service
- Your violation of any applicable law or regulation
- Your submitted artwork or content, including any claims of intellectual property infringement
- Your breach of any representation or warranty made in these terms
- Any dispute between you and a third party related to products you create using our services
- For Make Your Mark web clients: your website content and business operation, and the personal data you collect from your site visitors
This indemnification obligation will survive the termination of these Terms of Service and your use of our services.
13. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.
By using our website and services, you consent to the collection and use of your information as described in our Privacy Policy.

14. Changes to Terms
We reserve the right to modify or update these Terms of Service at any time at our sole discretion. Changes will be effective immediately upon posting to our website.
Notification of Changes:
- Material changes will be noted with an updated “Last Updated” date at the top of this page
- For significant changes, we may provide additional notice via email or website announcement
Your Continued Use:
Your continued use of our website or services after any changes constitutes acceptance of the modified terms. If you do not agree to the updated terms, please discontinue use of our services.
We recommend reviewing these Terms of Service periodically for any updates.
15. Governing Law
15.1 Jurisdiction
These Terms of Service and any disputes arising from your use of our website or services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
15.2 Venue
Any legal action or proceeding arising out of or related to these Terms of Service shall be brought exclusively in the state or federal courts located in Williamson County, Texas. You consent to the personal jurisdiction of such courts.
15.3 Dispute Resolution
Before initiating any legal action, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will make reasonable efforts to resolve disputes within 30 days of receiving notice.
15.4 Waiver of Class Action
To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
